Use of the Website

This site may be used by customers to browse the content and products and to make legitimate purchases. Persons may not use this site for any purposes such as fraudulent or speculative transactions or to copy, reproduce, republish, or redistribute any of the images or content available on the site.

Description of Goods and Services

This online store of Antech Pharmaceuticals (Pty) Ltd sells clinically proven natural complementary medicine.

Agreement of Sale

An agreement of sale between Antech Pharmaceuticals and the customer is only valid once the payment has been made and Antech receives proof of payment.  Unless an agreement of sale is valid, all goods remain the property of Antech Pharmaceuticals.

Deliveries and Product Availability

Subject to availability and receipt of payment, orders will be processed and delivered within 3-7 working days from activation of Sales Agreement.

All orders are dispatched via the courier service or international air mail.

International orders, that is orders to be delivered outside of the Republic of South Africa, are subject to a longer lead time and higher courier cost.

Customers accept that in order for Antech Pharmaceuticals to prove delivery of an order, we do not have to prove that you personally received the goods, but rather that any person at the delivery address signed for the delivery.

Lead time is dependent on stock availability. Should stock not be available, the additional lead time will be communicated to the customer and therefore be the customer’s choice to continue with the sale.

Every effort is made to effect shipment of orders timeously, however unforeseen circumstances may cause delays. Should we be faced with such an occurrence, Antech Pharmaceuticals will contact the customer via email and provide a revised shipping schedule.

Return and Refunds

An order can be cancelled if the payment for the order has not yet been made by the customer. Once the payment for an order has been made by the customer, the order can be cancelled with a cancellation fee equal to 20% of the total Tax Invoice amount charged to the customer. The customer will also be responsible for any return/shipping cost with regards to returning the products to Antech Pharmaceuticals. Products must be returned in its original sealed packaging and without any damages or breakage.

If a product is damaged or broken when a customer receives it, Antech Pharmaceutiacls should be informed within one working day of receiving it. Antech Pharmaceuticals will, at their expense, make the necessary arrangements for a replacement product to be sent to the customer.  A customer can be refunded in full for damaged or broken products if an inspection of the damaged items by Antech Pharmaceuticals deems it refundable and if the product is in its original sealed state.  Such refunds will be processed within 30 days from receipt and inspection of the damaged product by Antech Pharmaceuticals. If the products are opened or used by the customer, Antech Pharmaceuticals will not obligated to refund a customer.

If the incorrect product was sent to a customer, the customer must notify Antech Pharmaceuticals within ten (10) working days.  The order will be traced, and any errors made by Antech Pharmaceuticals will be rectified at the expense of Antech Pharmaceuticals.  If such products are not received by Antech Pharmaceuticals in the original sealed state, Antech Pharmaceuticals will have no obligation to replace the product.

Payment Options and Pricing

Payments are made on the website through PayFast, which has options to pay by Visa and Mastercard cheque and credit cards, by instant electronic fund transfers (EFT), Zapper, and debit cards.  Should any of these payment methods be not suit the customer, please contact Antech Pharmaceuticals on info@antechpharma.com to discuss other payment options.

Please ensure that the details entered are correct – Antech Pharmaceuticals will not be liable for any issues arising from details entered incorrectly. Please note that all credit/debit card holders are subject to validation checks and authorisation by the issuer of the card. If the issuer of the payment card refuses to pay or authorise a payment to the online store of Antech Pharmaceuticals for any reason, Antech Pharmaceuticals will not be liable for any delay or failed transactions or merchandise not delivered. Antech Pharmaceuticals retain the legal ownership of all merchandise until full payment has been made by the customer and received by Antech Pharmaceuticals.  Legal ownership of the merchandise will immediately transfer back to Antech Pharmaceuticals from the customer once any refunds of payments for merchandise are processed. Any risks associated with the merchandise are automatically transfered to the customer upon delivery of the merchandise.

All prices included Value Added Tax (VAT).

The total order price include the price of the purchase plus any applicable sales tax and shipping charges if selected.

Antech Pharmaceuticals reserves the right to change pricing at any time without prior notice.

Credit Card Acquiring and Security

Credit card transactions will be acquired for Antech Pharmaceuticals via Virtual Card Services, which use the strictest forms of encryption.

Customer Details Separate from Card Details

Antech Pharmaceuticals will store customer details separately from card details which are entered by the customer on the Virtual Card Services secure payment terminal. For more details on Virtual Card Services visit the Virtual Card Services website.

Merchant outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the card holder is South Africa. The transaction currency is South African Rand (ZAR).

Responsibility

Antech Pharmaceuticals takes responsibility for all aspects relating to the transaction, including sales of goods and services advertised on this website, customer service and support, dispute resolution, and delivery of goods.

Disclaimer

Antech Pharmaceuticals strives to have up-to-date and accurate information on this website, and to have products sold/promoted that cause no harm to customers or the environment.  However, due to the possibility of human and technical error, Antech Pharmaceuticals accepts no responsibility for the accuracy or completeness of information provided on the website or adverse reactions that any of the products may cause.

Antech Pharmaceuticals has taken every reasonable measure to ensure that the products promoted on this website are of the highest quality and safety.  Even though all products are clinically proven, the recommendations on this website and on the product labels are not necessarily based on recommendations of a medical practitioner. It is therefore advised to consult a medical practitioner if there is ever any doubt regarding the use of the products.

Country of Domicile

This website is governed by the laws of South Africa and Antech Pharmaceuticals chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature: 5 Ednau Small Holdings, Abrahamskraal Road, Mooiwater, Bloemfontein, 9338, Republic of South Africa.

Variation and Change of Terms and Conditions

Antech Pharmaceuticals may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Intellectual property

The trade marks, logos, and service marks (‘intellectual property’) displayed on our website are the registered and unregistered marks of Antech Pharmaceuticals, its affiliates, its suppliers, and its licensors and are protected by South African and international trade mark laws. Except in connection with placing an order for merchandise or as required by applicable law, visitors to the website and customers of Antech Pharmaceuticals may not use, reproduce, duplicate, copy, sell, resell, access, modify or otherwise exploit the intellectual property of Antech Pharmaceuticals or that of its suppliers without prior written consent from Antech Pharmaceuticals or its supplier.

Complaints

Antech Pharmaceuticals operates a complaints handling procedure which will be used to try to resolve disputes when they first arise. Please inform Antech Pharmaceuticals of any complaint in writing at info@antechpharma.com.

Product Liability

Antech Pharmaceuticals shall not be held liable for any damages, injury or illness caused by the misuse of any product.  It is the sole responsibility of the customer to read all product instructions carefully, to use the product strictly for the purpose it was designed for, and to ensure that the product is used in a safe and reasonable manner.  Antech Pharmaceuticals shall not be held responsible for any damages, injury or illness that occur due to an allergic reaction, or as the result of any other unforeseen occurrence – all the ingredients are listed on the product description and should be read carefully to identify any ingredients known to cause allergies to the customer.

Statutory rights

Nothing contained in these Terms and Conditions of Sale affects or will affect the statutory rights of the Customer or the Recipient in relation to the quality, fitness or description of the goods supplied.

Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Antech Pharmaceuticals for any civil action or any legal action deemed necessary against me.
